Wage & Hour Update: New Overtime Rules and Other Developments From the Workplace

Abstract: After intense congressional and administrative struggle, the U.S. the Department of Labor promulgated final regulations modifying the definitions of who is an "exempt" employee for wage and hour purposes. The new regulations work the first modification of the "exempt" employee definition in decades and are highly controversial among labor unions and others. Among other changes, the new rules move more "new economy" workers into the "exempt" category. After decades of reliance on interpretations of existing regulations, employers are struggling to timely implement the new rules.
